1. General.
On Aug. 14, 2013, the law of July 17, 2013 inserting Book III "Freedom of establishment, provision of services and general obligations of enterprises", into the Economic Code was published in the Belgian Official Gazette. On 09.05.2014 this provision entered into force.
Under this new law, lawyers as service providers must comply with a number of new obligations.
Mr. DE DECKER always concludes a specific fee agreement with his clients in which all specific information and fees are made available to the client. This information is also available digitally and at the office.
2. Your lawyer and his office.
You entrust your case to Mr. Bart De Decker, a lawyer in Belgium and registered at the Dendermonde Bar since September 2013.
Mr. De Decker practices the profession of lawyer in the form of a Private Limited Liability Company BV CALADRIUS with VAT number BE0756.575.353, established in 9140 Temse, Kouterstraat 20 known with commercial name FRONTLINE ADVOCATEN.
Mr. De Decker practices in a partnership with Nicolas Peeters, lawyer registered at the Dendermonde Bar.
Mr. De Decker's professional liability is insured with AMLIN Europe, civil professional liability of lawyers, Orde van Vlaamse Balies.... Broker Vanbreda Risk and Benefits.
The professional liability of Mr. De Decker, insures/provides coverage in the following countries: The cover under the Amlin policy civil professional liability (first tier) applies to the consequences of acts committed throughout the world,for activities performed by Mr. DE DECKER from his office based in Belgium.
Not insured are claims instituted in the U.S. or Canada, or under the laws or jurisdiction of the U.S. or Canada.

A lawyer's statement of expenses and fees may include three elements: the lawyer's fee,the lawyer's office costs and court costs and expenses.
Unless a law or a decree or administrative decision (circular or other) issued in implementation thereof provides for an exemption (including a transaction outside the scope of VAT), the fee will be increased by VAT at the applicable rate.
For office expenses, the following rates are charged by Frontline Lawyers:
- Start-up/closing file : EUR 50.00
- Dacytolography per page : 10,00 EUR
- By letter/e-mail : EUR 10.00
- Registered mail : 15,00 EUR
- Telephony : 5,00 EUR per call
- Travel allowance : 0.50 EUR per kilometer
Court fees and expenses advanced are charged to the client at the rate paid.
The "fee" is the remuneration for the lawyer's intellectual services. The method of charging the fee is agreed with the client during the initial consultation.
Depending on the case, services may be charged at an hourly rate or at a flat rate discussed at the initial consultation with the client.
FRONTLINE ADVOCATES may request one or more advance payments prior to the commencement of the assignment and during the course of the handling of the case. An advance is the lump sum amount paid by the client to Frontline Lawyers , prior to a detailed statement of costs and fees. Advance payments, in accordance with margin number 93 of the Circular AA Fiscnr.47/2013 (E.T. No. 0124.411) dated November 20, 2013, in the amount of 50% shall be deemed to relate to costs that may be passed on outside the taxable amount of VAT.
In the final statement of expenses and fees, the advances will be deducted from the total amount. An adjustment will then be made (in plus or in minus) of the VAT on the expenses advanced, in accordance with the provisions of marginal number 93(2) of the November 20, 2013 circular mentioned above.
If warranted, Frontline Lawyers may ask the client to pay a commission within the meaning of section 10 of administrative decision E.T. 125.682/3 dated April 18, 2014 of the VAT Administration. Provided that the four conditions listed therein are met,no VAT shall be charged on such commission until such time and to the extent that the commission is not used by Frontline Advocaten to pay all or part of its fees and expenses.
The client shall pay the advances and the final statement of expenses and fees of Frontline Advocaten within fourteen days after receipt of the invitation to pay. Frontline Lawyers may, if necessary for the proper provision of services, specify a shorter payment period, with justification.
If the client does not agree with the requested retainer or final statement, he must protest it in writing within fourteen days of receipt.
After written demand for payment of the outstanding statement of costs and fees and in the absence of a protest found to be justified, the client shall owe interest on the outstanding balance equal to the legal interest rate from the date of the demand. A fixed cost of €10 will be charged per reminder.
The agreement you enter into with Mr. DE DECKER is subject to Belgian law and for any disputes, as the case may be, only the District Court of the Enterprise Court of East Flanders, Dendermonde Division, the Court of First Instance of East Flanders, Dendermonde Division, or the Justice of the Peace of the Canton of Hamme shall have jurisdiction.
Any recovery of a declared statement of fees and expenses shall be preceded by an attempt at amicable settlement through convocation in conciliation before the Justice of the Peace at Hamme.
